STEINERT, J. -- Plaintiff, as guardian ad litem for Wilmer Bunney, a boy thirteen years of age, brought suit against defendants, a corporation and two individuals composing a partnership, to recover damages for personal injuries sustained by the minor. The boys injuries were caused by fire, resulting from an explosion on a truck which was owned by defendant Pound Motor Company and was being maneuvered at the time by a member of the partnership composed of David Bunney and Clarence Bunney, the uncle and father, respectively, of the minor. In the same action, plaintiff, as assignee, also sought to recover for the necessary medical and hospital expenses incident to the treatment of the injured boy. The two Bunney brothers, composing the partnership, defaulted, and, upon a trial by jury, a verdict was returned in favor of plaintiff against all of the defendants. From that judgment, defendant Pound Motor Company alone has appealed.
